    Former FBI Director James Comey was arraigned on Wednesday morning on two federal charges related to his Senate testimony in 2020.

    A grand jury in the Eastern District of Virginia indicted Comey last month. He was indicted on two counts – false statements and obstruction of a congressional proceeding.

    If convicted, James Comey is facing up to five years in prison.

    Comey’s case was assigned to US District Judge Michael Nachmanoff, a Biden appointee.

    James Comey’s lawyer, Patrick Fitzgerald, entered the not guilty plea on his client’s behalf on Wednesday. The trial date was set for January 5.

    Comey is expected to file a motion to dismiss the case for ‘vindictive prosecution’ and will challenge US Attorney Lindsey Halligan’s appointment.

    Last month President Trump announced he appointed Lindsey Halligan as US Attorney for the Eastern District of Virginia after he fired US Attorney Erik Siebert.

    Trump fired Siebert because he refused to charge Comey, Letitia James and Adam Schiff.

    Lindsey Halligan was sworn in as Interim US Attorney for the Eastern District of Virginia and a few days later she indicted James Comey.

    Fitzgerald told Judge Nachmanoff that he will be filing the motion to challenge Halligan’s appointment but it will be heard by another judge.

    The Biden judge took a few jabs at the DOJ attorneys arguing on behalf of the government on Wednesday.

    Halligan brought in two Assistant US Attorneys from the Eastern District of North Carolina to try Comey: Nathaniel Lemons and Gabriel Diaz.

    Government prosecutor Nathaniel “Tyler” Lemons told the judge that his team needs a little more time in the case and the judge was skeptical of how complicated the indictment really is.

    A schedule for pretrial motions was released later Wednesday.
