    Joe Biden has given up the fight and declined to seek further review of an appeals court ruling on the release of 70 hours of conversations with his ghostwriter, Mark Zwonitzer.

    A three-judge panel of the U.S. Court of Appeals for the D.C. Circuit on Monday denied former Joe Biden’s emergency motion for an injunction pending appeal that sought to block the Justice Department from releasing redacted transcripts and audio recordings of his private conversations with ghostwriter Mark Zwonitzer.

    The 2-1 order, in Heritage Foundation and Mike Howell v. United States Department of Justice, was signed by Chief Judge Sri Srinivasan (Obama appointee) and Judge Gregory Katsas (Trump appointee). Judge Florence Pan (Biden appointee) dissented and would have granted the injunction.

    The Oversight Project celebrated on Friday after Biden backed down.

    “Today, The Oversight Project obtained a complete and total victory over President Joe Biden’s autopen in his sad, but predictable efforts to withhold the recordings of his interviews with his ghost writer. Biden’s declination to seek further review of the D.C. Circuit’s ruling paves the way for the release of the interview tapes,” the Oversight Project said in a press release on Friday.

    “Today’s victory is the latest in a string of Oversight Project wins over the autopen President. The autopen’s efforts to block transparency here were decisively rejected by both the Court of Appeals and the District Court,” they said.

    “Last year, we secured the release of the audio recording of President Biden’s interview with Special Counsel Robert Hur. Our work uncovering the prolific and unlawful use of the Biden autopen has revealed the serious threats to our constitutional republic that Democrat leadership poses,” the Oversight Project said.

    Robert Hur in February 2024 released a 345-page report on his investigation of the stolen classified documents.

    Robert Hur found that Joe Biden “willfully retained” classified information, however, he decided not to charge him. Hur said there is evidence Biden retained classified notebooks, “knowing he was not allowed to do so.”

    Biden was not charged even though he willfully retained SCIF-designated classified documents and shared material with his ghostwriter Mark Zwonitzer.
